1. Acceptance of Terms
By accessing or using the Cafendo platform (the “Service”), you agree to be bound by these Terms of Service. If you do not agree to all terms, you may not use the Service. We reserve the right to update these terms at any time, and continued use of the Service after changes constitutes acceptance of the revised terms.
2. Account Registration
To make purchases on Cafendo, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to keep your account credentials secure. You are responsible for all activity that occurs under your account. If you suspect unauthorized access, contact us immediately at support@cafendo.com.
3. Orders & Payment
All orders placed through Cafendo are subject to acceptance by the respective vendor. Prices are listed in the currency applicable to your selected region and include applicable taxes unless otherwise stated. Payment is processed securely through Stripe at the time of purchase. We reserve the right to cancel orders in cases of pricing errors, suspected fraud, or product unavailability.
4. Shipping & Delivery
Shipping is fulfilled by individual vendors on the Cafendo marketplace. Estimated delivery times are provided at checkout and may vary by vendor, product, and destination. Cafendo is not responsible for delays caused by carriers, customs, or force majeure events. Risk of loss passes to the buyer upon delivery to the carrier.
5. Vendor Terms
Vendors on Cafendo operate as independent sellers. Each vendor is responsible for the accuracy of their product listings, fulfillment of orders, and compliance with applicable laws. Cafendo facilitates transactions between vendors and buyers but does not manufacture, store, or ship products directly. Vendors agree to a commission structure as defined in their vendor agreement.
6. Intellectual Property
All content on the Cafendo platform — including but not limited to logos, design, text, graphics, and software — is the property of Cafendo or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without prior written consent. Vendors retain ownership of their product images and descriptions.
7. Limitation of Liability
To the maximum extent permitted by law, Cafendo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the competent courts located in Romania. If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
